Transactions Act, neither Accommodation South Africa nor any of its agents or representatives shall be
liable for any damage, loss or liability of whatsoever nature arising from the use or inability to use this
web site or the services or content provided from and through this web site, or from our email or
telephone support. Furthermore, Accommodation South Africa makes no representations or warranties,
implied or otherwise, that, amongst others, the content and technology available from this web site are
free from errors or omissions or that the service will be uninterrupted and error free. Users are
encouraged to report any suggested improvements , possible malfunctions and errors to

Accommodation South Africa website . Accommodation South Africa is not liable or responsible in any
way for the verification or accuracy of any Guest comments made.
1.5 All services purchased through Accommodation South Africa are made pursuant to agreements
between enquirers and owners and operators of accommodation Establishments .Risk of loss passes
from Accommodation South Africa to Establishment owners and operators upon their receipt of
acceptance of booking from our website, including but not limited to ghost enquiries, fraudulent
transactions, bad debts, short, late or non payment, cash, bank or credit card charges, credit card fraud,
credit card charge backs, theft, loss of property, injury to guests, request for refunds , cancellations , early departures or late arrivals or otherwise.
1.6 Neither Accommodation South Africa nor any of its agents or representatives shall be liable for any
damage, loss or liability of whatsoever nature arising from the use or inability to use any service sold or
offered by this web site.
1.7 Accommodation South Africa makes no representation regarding any other web sites that may be
accessed through this service and accordingly accepts no responsibility for the content or use of such
web sites or information contained therein. In addition, it shall not be liable to any party for any form of
loss or damage, consequential or otherwise, incurred as a result of any use or reliance on any
information contained on such a web site or any web sites which can be accessed through this web site.
2. PAYMENT OF BOOKINGS
2.1 Once an offer has been accepted, and the Establishment is notified of this booking , the Establishment is solely responsible to immediately ( within maximum 24 hours ) make contact with the Guest to confirm the booking and to provide their own invoice with their required deposit and full payment details to the Guest. Once accepted , the Establishments offer and its acceptance by Enquirer become a binding contract, between Enquirer/Guest, Establishment and Accommodation South Africa.
Following receipt of payment, the Establishment is required to send confirmation of receipt of payment to the
Guest, advise the balance outstanding if any, and include clear directions for Guest to arrive at the Establishment address, as well provide owners/ managers emergency phone numbers.
2.2 The Establishment is solely responsible, to enter details via the registration process, of their own particular deposit
or full payment requirements, plus their own cancellation policy and terms and conditions. These payment options and Establishment
conditions will be advised to the Enquirer as part of the Establishment offer.
3. HOW PROCESS WORKS
3.1 The Enquirer makes an enquiry by filling in his requirements on a form on our website,and advising the maximum amount he wishes to pay for sleeping all persons for his entire stay. If your Establishment is in the selected Town/City-Suburb and your Establishment offers the Type of accommodation requested ,we will send you this enquiry via email.
If you have no or only partial availability, or your considered offer is higher than the budget price requested, then please do not reply to the enquiry, Simply delete or ignore this enquiry .
If an Establishment has available accommodation and their total price is within the Enquirers total price requested for the entire stay period ,and an offer for the entire stay and including sleeping all persons ,can be sent to the Enquirer.
If accepted your offer constitutes a binding contract between the Establishment, the Enquirer and Accommodation South Africa.The Offer can be Accepted or Declined, or the Enquirer can enter into correspondence with Establishment to ask questions and so make an informed decision of whether to book at Establishment or not.
Your offer is subject to your validity period that you determine for each enquiry . We recommend you select a 5 day (120 hour) validity period from the date that you email your enquiry .
You are required to provisionally reserve the rooms offered related to the offer for your validity period as advised , unless you have been notified by the system that your quote has been Declined or until the validity period expires.
You will be notified if offer is declined and when your validity period has expired you can the re offer the room/unit.
Ensure your calculation of your total price offer for entire stay is correct before replying as this price cannot be changed once submitted. .
If enquirer accepts then offer and price is binding and enforceable, together with the related commission due, even if your price is incorrect!
3.2 When an offer is accepted , we will provide with the Guests contact details.You are immediately ( within 24 hours at the latest) required to contact the Guest to finalize and confirm the booking and to arrange and receive your deposit or full payment directly from the Guest, as per your Establishments terms and conditions entered when you registered your details on our website.
3.3 Establishments should apply their own terms and conditions and cancellation policies and these will be advised in
in every quotation.
4. TERMS AND CONDITIONS FOR USING THIS WEBSITE
4.1 Our referral commission Invoice will be emailed to you on the day of arrival of your Guest.
All invoices must be paid in full by Internet or Bank transfer only and free of any bank charges,within 7 days of receipt of invoice to

Kindly use the Accommodation Southafrica Invoice Number eg. ASA 125 and your
Establishment name as a reference when making payment and send copy at the same time of the

4.2 In the case of any amounts owing to Accommodation South Africa by the Establishment, which
remain unpaid for a period of 14 days or more from invoice date , the Establishment agrees to pay in addition to the outstanding amount,a collection penalty fee of 25% on the total outstanding commission amount plus any other costs that may be associated with
the recovery of the debt, including summons and attorney fees.
4.3 Bookings through this website are subject to any Cancellation policy that may be stipulated by the
Establishment in their terms and conditions as advised to the Guest
4.4 Where a direct booking is made via an Accommodation South Africa partner, or third party, Guests
should ensure they are familiar with the Establishment and partners cancellation policy.
4.5 Accommodation South Africa charges a non-refundable booking commission of 15% (amount not vatable!)
of the total booking value for the entire period, for facilitating the booking.
This full amount is due and payable within 7 days of Establishment receipt of our email invoice for this
referral commission due to Accommodation South Africa. Our invoice will be sent to you on the booked day of
arrival of your Guest at your Establishment.
Accommodation South Africa may in certain circumstances only, consider amending the
Establishment Commission invoice, but only provided email detail is received from both Establishment and Guest proving these changed Circumstances.
To prevent queries or delays in payment, Establishments must provide written proof from both
themselves and Guests of any changes to their confirmed booking ( ie. shortened or lengthened stay, or
lesser or more numbers needing accommodation ). This info to be sent to firstname.lastname@example.org and
to be received no later that 7 days before the date of arrival of the Guest.
No amending of invoices will be allowed 7 or less days before arrival or once the invoice has been emailed on the day of Guests arrival.
NB. Any changes to invoices may be classed as a STRIKE against your future use of this website ( see details
By using this accommodation booking service, the user acknowledges that Accommodation South Africa is entitled to receive
this commission in the event of a booking cancellation. In addition, in the event that an Establishment
retains a Guest deposit payment in terms of its own cancellation policy, then under no circumstances
shall Accommodation South Africa be held liable for repayment thereof.
An offer made to a Guest by an Establishment is binding during the validity
period of the Establishments receipt offer as advised. Should the Guest confirm an offer during this validity
period or make payment to the Establishment ,and the Establishment either refuses to honor or accept
the booking or subsequently cancels the booking for any reason,the Establishment will be deemed to be
in breach of contract . Establishments will still be liable for the payment of the relevant commission for
this disputed/cancelled enquiry due to Accommodation South Africa.
By loading their Establishment details onto this website , and replying to enquiries with offers , the
Establishment unconditionally expresses their full agreement to the above conditions.
4.6 THIS WEBSITE RELIES ON TRUST AND HONESTY
We will provide you with many FREE Enquiries! You decide whether to quote or not and what price to offer.
If You get a confirmed Booking you must immediately contact the enquirer to finalize and confirm the booking and to arrange for the Deposit and Full payment to be paid directly to your Establishment .
When your Guest arrives, we invoice you and trust you to PAY US our referral commission due, Within 7 days !

The receipt of the booking commission is important to funding the development and running costs of this
website. Any attempt by Establishments or Guests to provide email addresses, telephone numbers,
contact details ,or provide any other confidential details in an attempt to avoid paying commission or
reduce the commission due ,is expressly prohibited. Any statement or hint made by the Establishment
suggesting that the Guest should go directly to the Establishments own website or that they can book directly or offer them alternative accommodation elsewhere is strictly forbidden.
Transgressors will be issued with a STRIKE warning. Any further infringements or a blatant attempt to by pass this
condition will lead to Establishments being banned from website and there by unable to reply to
offers and receive confirmed bookings.
A 3 Strikes and you are out policy will be strictly enforced for both Users and Establishments for any transgression of any
published rule or any unacceptable action whilst using or effecting the workings of this website.
Strike awards result from any infringement, including amended invoices or late or non payment of commission due.
Once you have received 3 strikes you will be prevented from using the website.
4.7 By responding to the Guest either with a quote or a reply, the Establishment accepts that the
introduction has been made by Accommodation South Africa and undertakes to pay Accommodation
South Africas standard 15% commission in the event that a booking is made by the Enquirer either through
Accommodation South Africa or, directly with the Establishment or, via any other 3rd party.
4.8 Accommodation South Africa is not liable for incorrect dates or rates as quoted on the web site and will not
be obliged to supply accommodation bookings for those dates or at those rates. The reply, price offer, terms and
conditions and validity period for each offer made , is the sole responsibility of the Establishments.
5. GOVERNING LAW
5.1 This site is managed, controlled and operated from the Republic of South Africa and is therefore
governed by South African law.
6.1 Accommodation South Africa shall take all reasonable steps to protect the personal information of
Users. For the purpose of this clause, "personal information" shall be defined as detailed in the
Promotion of Access to Information Act 2 of 2000 (PAIA). The PAIA may be downloaded from:

every user on the system and may store, not withstanding other information, the following; name and
surname, birth date, e-mail address, telephone numbers, cellular numbers, physical addresses, other
personal information including website surfing habits, IP numbers, username and passwords for the system, the
booking and client preferences and any other information the user submits to this website.
Accommodation South Africa only stores this information when a user has consented to these terms and
conditions. Personal information regarding Establishments listed on the website is stored on the system when the User registers the Establishment details. Establishment Users/Owners are required, in every instance, to specifically indicate their consent to these terms and conditions before they are able to send a quotation in response to an enquiry.
7.2 Any person that delivers or attempts to deliver any damaging code to this web site or attempts to
gain unauthorized access to any page on this web site, or uses this website to market or advertise their products or business, shall be prosecuted and civil damages shall be claimed in the event that Accommodation South Africa suffers any damage or loss.
7.3 Our website enquiry form is an accommodation enquiry form only and is not to be used as a sales aid. Any person/parties using this form to contact Establishments for marketing purposes or to distribute unsolicited mail or SPAM may be prosecuted.

websites and or services.
Accommodation South Africa may, in its sole discretion, change this agreement or any part thereof at
any time without notice.

agreement, whether in respect of court process, notice, or other documents or communication of

The Accommodation South Africa website operates as an online accommodation guide to enable users
to easily Enquire, Find, Compare, Select, Book and Pay Establishments directly for their chosen preferred accommodation.
Accommodation South Africa thus acts as an advertising medium for the Establishment and facilitates
enquiries, offers, and booking confirmations between Establishments and Enquirers/Guests .The contract is
based on an offer by the Establishment, which is accepted by the Enquirer, and therefore exists legally
between these two parties. Accommodation South Africas responsibility with regard to this website
and its use is to assist both parties to engage and confirm an accommodation booking. Establishments
confirm,arrange and receive payment from the Guest directly for the full amount . For this service
Establishments agree to pay to Accommodation South Africa a 15% commission ,calculated on the full total amount on every confirmed booking. Commission payable within 7 days of the Guests arrival and receipt of our invoice.
In the event of a dispute between the Enquirer/Guest and the Establishment , Accommodation South Africa will
assist as much as possible, in resolving such dispute. Accommodation South Africa does not, however,
underwrite or guarantee bookings between Enquirer/Guest and Establishment or the accuracy of the information
portrayed by the Establishment in their offer. In the event of any dispute between Enquirer/Guest and
Establishment, Accommodation South Africa will assist , to the best of its ability, with the resolving of
such disputes but is not liable to either party for any claims, damages or refunds of any type.
